The general business conditions determine the operation of the online store, the rights and obligations of the user and the store, and regulate the business relationship between the www.fresh32.eu online store and the customer.

The customer is bound by the general conditions valid at the time of purchase (submission of the online order).

  • method of payment and delivery,
  • time validity of the offer,
  • the period in which it is possible to withdraw from the contract and the conditions for withdrawal,
  • an explanation of the complaint procedure, including all information about the contact person or customer service department.

The prices and offers of the items are limited in time, and with the passage of time, Fresh 32 doo reserves the right to extend the offer, change the price or withdraw the offer.

The order

The sales contract between the www.fresh32.eu online store and the customer is concluded in the www.fresh32.eu online store at the moment when www.fresh32.eu sends the customer the first email about the status of his order. From this moment on, all prices and other conditions are fixed and apply both to the online store www.fresh32.eu and to the customer. The person with the information specified when placing the order is considered a buyer.

The purchase contract (ie the first electronic message about the status of the order) is stored in electronic form on the www.fresh32.eu server.

Delivery time

The products are shipped from the warehouse within 2-3 working days from the day of the order, if they are in stock. The courier service takes 1-2 working days for delivery in the area within the Republic of Slovenia. If the product is not in stock, the online store www.fresh32.eu informs the customer about the first possible delivery.

Payment methods

The online store www.fresh32.eu allows the following payment methods:

  • Payment on collection: Make the payment directly to the GLS courier upon collection of the package.
  • Payment by credit cards: We accept Mastercard, Visa, Diners, and Maestro through the online payment provider Mollie.
  • Payment via the PayPal system: At the end of the ordering process, you are redirected directly to the PayPal system, where you can make the payment.

Delivery costs

GLS courier service delivers for us. The price of shipping with payment by advance invoice, with credit cards or via the PayPal system is €3.50. Shipping is free for purchases over €40.00.

Products are shipped from the warehouse within 2-3 working days, if they are in stock. If the product is not in stock, the online store www.fresh32.eu informs the customer and informs him of the delivery date of the product.

We deliver products within the territory of the Republic of Slovenia.

Invoicing

The customer receives the invoice to the specified email address after payment.

The price and all costs related to the purchase are detailed on the invoice. The buyer is obliged to check the correctness of the data before placing the order.

Prices

All prices include VAT. Prices are valid at the time of placing the order. The prices are valid in the case of payment with the above-mentioned payment methods, under the above-mentioned conditions.

Despite our best efforts to provide the most up-to-date and accurate information, it may happen that the price information is incorrect. In this case, or in the event that the price of the item changes during the processing of the order, www.fresh32.eu will allow the customer to withdraw from the purchase.

Discounts, promotional codes, etc. as a rule, they do not add up. Codes or discount codes cannot be exchanged for cash.

Discount code

The discount code brings various advantages when purchasing through the online store www.fresh32.eu and is limited in time, and must be used within a limited specified period, otherwise it is invalid. You can find the active discount code on the front page of the advertising message, in our e-newsletter or other media, if the codes are active.

In the event that the customer uses a discount code, but later cancels the order with the used code of his own free will, he is no longer entitled to a new benefit from this code.

The discount code is a one-time code, which means you can only use it once. The combination of different types of benefits (discount code, promotional code and bonus) within the same order is not possible.

Using a discount code

Only one discount code can be applied per purchase.

  • Choose the product you want to buy and put it in the cart.
  • When completing the purchase at the checkout, enter the discount code in the DISCOUNT CODE box and click the CONFIRM button.
  • When you enter a discount code, the value of the discount code is automatically deducted from the price of your order. There remains an amount that still needs to be settled.

Purchase process

Product selection: On the website www.fresh32.eu, select a product with the number of products. The selected product is moved to your basket. You can continue with the purchase, using the same product selection process or products, but you can complete the purchase.

Removing a product from the shopping basket: On the website www.fresh32.eu there is a shopping basket icon in the upper right corner, in which (after clicking on the icon) the user will see the products that he added to the shopping basket while browsing the online store. If the user wants to remove a certain product from the shopping cart, he must click on the number of products and select 0. This will remove the selected product from the cart.

Completion of the purchase: To complete the order, you must fill in the indicated fields.

  • Delivery address: You must provide the required contact information marked with a red star (name, surname, e-mail address, address, city, postal code and telephone number), which we need to confirm and complete the order and deliver the product.
  • Payment method: You can choose between cash on delivery or payment by credit card or payment via the Paypal platform.
  • Order continuation: By clicking on the SUBMIT ORDER button, you move to the next step of the order.
  • Additional offer: An additional offer will be displayed on the website, which you can skip and thus complete the purchase, but if you would like to buy the product, it will be automatically added to your order by clicking the BUY button.
  • Order overview: If the order has been successfully submitted, you will see Thank you, we will send the order to the address below.

Order Confirmation

After submitting the order, the buyer receives a notification by e-mail that the order has been accepted. The online store www.fresh32.eu reviews the order, checks the availability of the ordered products and confirms the order or rejects it with a reason. www.fresh32.eu may call the customer on his contact phone number to check the data or to ensure the accuracy of the delivery. The products shown on the website www.fresh32.eu are in stock. In the event that the product is not in stock, www.fresh32.eu will inform the customer about this and inform him of the delivery date of the product. If the delivery time is very long and the buyer does not want to wait, the buyer can notify www.fresh32.eu, which will remove the product from the order and return any funds already paid to the buyer, and deliver the other products from the order at the buyer's choice, or canceled the entire order.

Shipping the order

The online store www.fresh32.eu prepares and ships the products within the agreed period and informs the customer about this by e-mail.

If the buyer decides to cancel the order in time, he must notify the seller immediately via the form or by e-mail to the address info@fresh32.eu. If it happens that the order has already been shipped, the buyer rejects the shipment to the delivery service.

Purchase for legal entities

The purchase procedure for legal entities is exactly the same as for natural persons, except that at the end of the purchase, enter the name of the company and the tax number of the company.

The consumer's right to withdraw from the contract

In the case of contracts concluded at a distance, the consumer has the right, within 14 days after taking over the products, to the company at the email address info@fresh32.eu or through some other communication channel, without any doubt, to inform him that he withdraws from the contract, without having to give a reason for your decision.

The deadline starts counting one day after the date of collection of the products.

In addition to the returned product in its original, unopened and undamaged packaging, it is necessary for the customer who withdraws from the contract to state the reasons for returning the product in order to obtain feedback to improve consumer service.

The consumer must return the goods to the company no later than 14 days after the notification of withdrawal from the order. The consumer returns the goods to the address Fresh 32 doo, Dunajska cesta 177, 1000 Ljubljana. The only cost charged to the consumer in connection with the cancellation of the order is the direct cost of the postage of returning the products.

We do not accept returned shipments with a ransom. Returned packages sent with a ransom note will be refused.

The consumer must return the product to the seller unopened, undamaged, unused and in the same quantity, unless the product is destroyed, damaged, lost or its quantity has decreased through no fault of the consumer. The consumer may not use the products until withdrawal from the contract. The consumer may inspect and test the products to the extent necessary to determine the actual condition. The consumer is responsible for the reduction in the value of the products, if the reduction is the result of conduct that is not absolutely necessary to determine the nature, properties and functioning of the products.

The consumer does not have the right to withdraw from the contract for contracts, the subject of which is an article that has been manufactured according to the precise instructions of the consumer, that has been adapted to his personal needs, that due to its nature is not suitable for return, that is perishable or that has already expired best before.

The company returns the received payments to the consumer using the same means of payment that the consumer used.

In case of withdrawal from the contract where a bonus, discount code or promotional code was used, these funds are considered as a discount and are not returned to the user. Only the paid amount is returned to the user.

A factual error

A material error is when:

  • the product does not have the properties necessary for its normal use,
  • the product does not have properties that are necessary for the specific use for which the buyer is buying it, but which the seller was aware of or should have been aware of,
  • the product does not have properties that have been expressly or tacitly agreed or prescribed,
  • the seller has delivered a product that does not match the sample or model, unless the sample or model has been shown for notification purposes only.

The buyer must notify the online store www.fresh32.eu of any material defect, together with a precise description of it, within the statutory deadline, and at the same time enable inspection of the item.

Liability for material errors

The seller is liable for material defects that the item had when the risk passed to the buyer, regardless of whether it was known to him or not. The seller is also responsible for those material defects that appear after the risk has passed to the buyer, if they are the result of a cause that existed before that. A slight material error is not taken into account.

Delivery

Our contractual partner for the delivery of shipments in the territory of Slovenia is the delivery service GLS, but Fresh 32 doo reserves the right to choose another delivery service if it can fulfill the order more efficiently.

Safety

The online store www.fresh32.eu uses appropriate technological and organizational means to protect the transfer and storage of personal data, orders and payments. The provider does not assume any responsibility and cannot be held liable for any damage to computer/hardware or other property, as well as possible introduction of viruses that could affect the user's equipment as a result of visiting the website, downloading texts, images, data.

Limitation of liability

The online store www.fresh32.eu does its best to ensure that the information published on the website is up-to-date and correct. Nevertheless, the characteristics of the items, the delivery time or the price can change so quickly that www.fresh32.eu sometimes fails to correct the information on the web pages or an error occurs. In such a case, www.fresh32.eu will inform the customer of the changes and allow him to withdraw from the contract or exchange the ordered product.

Also, www.fresh32.eu has the option of withdrawing from the contract only if an obvious error is found (Article 46 of the OZ). A mistake in the essential properties of the product and all mistakes which are considered decisive according to the customs of the trade or according to the customer's intention and which www.fresh32.eu would not have confirmed or entered into a contract if known, are considered to be an obvious error. This also includes obvious pricing errors.

Exclusion of liability

We reserve the right to disable the website or disable access to it due to technical or other problems and maintenance, which also means disabling or hindering the use of the online store. In the event of technical problems on the website, we reserve the right to cancel orders that were affected by the technical error. In case of cancellation of orders, we will notify you as soon as possible and inform you of further steps. The user must provide the appropriate protective equipment to access the website.

Complaints and disputes

The company Fresh 32 doo complies with the applicable legislation on consumer protection. Fresh 32 doo is doing its best to fulfill its duty of providing an efficient complaint handling system.

The complaint is submitted via the e-mail address info@fresh32.eu. The appeal process is confidential. The online store www.fresh32.eu will confirm within 5 working days that it has received the complaint, inform the customer how long it will take to process it and keep him informed throughout the process.

We are aware that an essential feature of consumer disputes is the disproportion between the economic value of the claim and the time and costs required to resolve the dispute, which is also the main obstacle for the consumer not to initiate a dispute before the court. Therefore, www.fresh32.eu makes every effort to resolve any disputes amicably.

Out-of-court settlement of consumer disputes

In accordance with legal norms, www.fresh32.eu does not recognize other providers of out-of-court resolution of consumer disputes as competent for the resolution of consumer disputes, with the exception of the below-mentioned platform for the online resolution of consumer disputes (SRPS), which the consumer can use in accordance with the Act on Out-of-Court Resolution of Consumer Disputes disputes.

Fresh 32 doo, which as a provider of goods and services enables online shopping in the Republic of Slovenia, publishes on its website an electronic link to the aforementioned platform for the online resolution of consumer disputes (SRPS). The platform is available to consumers here .

The aforementioned regulation comes from the Act on the Out-of-Court Settlement of Consumer Disputes, Regulation (EU) No. 524/2013 of the European Parliament and of the Council on the online resolution of consumer disputes and the amendment of Regulation (EC) no. 2016/2004 and Directive 2009/22/EC.
