The general terms and conditions of the online store www.fresh32.eu are composed in accordance with the Consumer Protection Act (ZVPot), Personal Data Protection Act (ZVOP-1), and Electronic Communications Act (ZEKom-1).

The general terms and conditions define the operation of the online store, the rights and obligations of the user and the store, and regulate the business relationship between the online store www.fresh32.eu and the customer.
The customer is bound by the general terms and conditions that are valid at the time of purchase (submission of the online order).
Accessibility of Information
Fresh 32 d.o.o. undertakes to always provide the customer with the following information:
- company identity (company name and registered office, registration and tax number),
- contact details that enable the user to communicate quickly and effectively,
- essential characteristics of goods or services (including sales services and warranties),
- product availability (every product offered on the website should be available within a reasonable timeframe, if in stock),
- product delivery conditions (method, place and delivery time),
- all prices must be clearly and unambiguously determined and it must be clearly shown whether they already include taxes and shipping costs,
- payment and delivery methods,
- clear validity of the offer,
- period within which it is possible to withdraw from the contract and withdrawal conditions,
- explanation of the complaint procedure, including all data about the contact person or customer service department.
Product Offer
Due to the nature of online business, the offer and prices in the online store www.fresh32.eu are updated and changed.
Product prices and offers are time-limited, and over time Fresh 32 d.o.o. reserves the right to extend the offer, change the price or withdraw the offer.
Order
The sales contract between the online store www.fresh32.eu and the customer is concluded in the online store www.fresh32.eu at the moment when www.fresh32.eu sends the customer the first electronic message about the status of their order. From that moment, all prices and other conditions are fixed and apply to both the online store www.fresh32.eu and the customer. The customer is considered to be the person with the data as stated when placing the order.
The sales contract (i.e., the first electronic message about the order status) is stored in electronic form on the www.fresh32.eu server.
Delivery - Terms
Products are dispatched from the warehouse within 2-3 business days from the order date, if in stock. The courier service takes 1-2 business days for delivery within the territory of the Republic of Slovenia. If the product is not in stock, the website www.fresh32.eu will notify the customer about the first possible delivery.
Payment Methods
The website www.fresh32.eu enables the following payment methods:
- Cash on delivery: Payment is made directly to the GLS courier upon receipt of the package.
- Credit card payment: We accept Mastercard, Visa, Diners and Maestro through the online payment provider Mollie.
- PayPal payment: At the end of the ordering process, you are redirected directly to the PayPal system where you can make the payment.
Shipping Costs
GLS courier service delivers for us. The shipping cost with prepayment, credit cards or through PayPal system is €3.50. For purchases over €50.00, shipping is free.
Products are dispatched from the warehouse within 2-3 business days, if in stock. If the product is not in stock, the website www.fresh32.eu will notify the customer and inform them of the product availability date.
We deliver products within the territory of the Republic of Slovenia.
Invoice Issuance
The customer receives the invoice at the specified email address after payment is made.
The invoice details the price and all costs related to the purchase. The customer is obliged to verify the accuracy of the data before submitting the order.
Prices
All prices include VAT. Prices are valid at the time of order submission. Prices are valid in case of payment with the above-mentioned payment methods, under the above-mentioned conditions.
Despite exceptional efforts to ensure the most up-to-date and accurate data, it may happen that the price information is incorrect. In this case, or if the product price changes during order processing, www.fresh32.eu will allow the customer to withdraw from the purchase.
Discounts, promotional codes, etc. are generally not cumulative. Discount codes cannot be exchanged for cash.
Discount Code
Discount codes bring various benefits when purchasing through the online store www.fresh32.eu and are time-limited, must be used within a limited specified period, otherwise they are invalid. Active discount codes can be found on the homepage of the advertising message, in our newsletter or other media, if the codes are active.
If the customer uses a discount code but later cancels the order with the used code on their own initiative, they are no longer entitled to new benefits from that code.
Discount codes are one-time codes, meaning you can only use them once. Combining different types of benefits (discount code, promotional code and bonus) within the same order is not possible.
Using Discount Codes
Only one discount code can be applied per purchase.
- Select the product you want to buy and add it to your cart.
- At checkout, enter the discount code in the DISCOUNT CODE field and click the CONFIRM button.
- When you enter the discount code, the discount value is automatically deducted from your order price. The remaining amount to be paid remains.
Using FRESH 32 Gift Card
FRESH 32 gift card has no expiration date, is transferable and can be used to purchase all products on the website www.fresh32.eu. The card cannot be exchanged for cash or any other form of payment. In case of loss, theft, damage or unauthorized use, we do not assume responsibility and refund is not possible. FRESH 32 reserves the right to temporarily or permanently disable card use without compensation in case of abuse, fraud or technical errors. By using the gift card, the user agrees to all general business terms of the company published on the website.
Purchase Process
Product selection: On the website www.fresh32.eu, select the product with the number of products. The selected product is added to your cart. You can continue shopping with the same product selection process, or you can complete the purchase.
Removing product from shopping cart: On the website www.fresh32.eu, there is a shopping cart icon in the upper right corner, where (after clicking the icon) the user can see the products they added to the shopping cart while browsing the online store. If the user wants to remove a specific product from the shopping cart, they must click on the number of products and select 0. This will remove the selected product from the cart.
Purchase completion: To complete the order, you must fill in the marked fields.
- Delivery address: You must provide the required contact details marked with a red asterisk (first name, last name, email address, address, city, postal code and phone number) that we need to confirm and complete the order and deliver the product.
- Payment method: You can choose between cash on delivery, credit card payment or PayPal platform payment.
- Order continuation: By clicking the SUBMIT ORDER button, you move to the next step of the order.
- Additional offer: An additional offer will be displayed on the website, which you can skip and complete the purchase, but if you would like to buy the product, it will be automatically added to your order by clicking the BUY button.
- Order review: If the order was successfully submitted, you will see "Thank you, we will send the order to the address below."
Order Confirmation
After submitting the order, the customer receives an email notification that the order has been accepted. The website www.fresh32.eu reviews the order, checks the availability of ordered products and confirms or rejects the order with a reason. For data verification or to ensure delivery accuracy, www.fresh32.eu may call the customer on their contact phone number. Products shown on the website www.fresh32.eu are in stock. If the product is not in stock, www.fresh32.eu will notify the customer and inform them of the product availability date. If the delivery time is very long and the customer does not want to wait, the customer can inform www.fresh32.eu, which will remove the product from the order and return any already paid funds to the customer, and deliver the remaining products from the order or cancel the entire order at the customer's choice.
Order Dispatch
The website www.fresh32.eu prepares and dispatches the products within the agreed timeframe and notifies the customer by email.
If the customer decides to cancel the order in time, they must immediately notify the seller through the form or by email at info@fresh32.eu. If it happens that the order has already been dispatched, the customer rejects the shipment to the delivery service.
Purchase for Legal Entities
The purchase process for legal entities is exactly the same as for individuals, except that at the end of the purchase, they also enter the company name and company tax number.
Consumer Right to Withdraw from Contract
For contracts concluded at a distance, the consumer has the right to clearly notify the company at the email address info@fresh32.eu or through any other communication channel within 14 days of receiving the products that they are withdrawing from the contract, without having to state a reason for their decision.
The period begins to run one day after the date of receipt of the products.
In addition to returning the product in original, unopened and undamaged packaging, the customer who withdraws from the contract must also state the reasons for returning the product for the purpose of obtaining feedback to improve customer service.
The consumer must return the goods to the company no later than 14 days after notifying the withdrawal from the order. The consumer returns the goods to the address Fresh 32 d.o.o., Dunajska cesta 177, 1000 Ljubljana. The only cost that burdens the consumer in connection with withdrawal from the order is the direct cost of return postage.
We do not accept returned shipments with cash on delivery. Returned packages sent with cash on delivery will be rejected.
The consumer must return the product to the seller unopened, undamaged, unused and in unchanged quantity, except if the article is destroyed, damaged, lost or its quantity has decreased, without the consumer being at fault. The consumer must not use the products until withdrawal from the contract. The consumer may inspect and test the products to the extent necessary to determine their actual condition. The consumer is responsible for any decrease in the value of the products if the decrease is a consequence of actions that are not necessary to determine the nature, characteristics and functioning of the products.
The consumer does not have the right to withdraw from the contract for contracts whose subject is an article that was made according to the consumer's precise instructions, that was adapted to their personal needs, that due to its nature is not suitable for return, that is perishable or whose expiration date has already passed.
The company returns the consumer's received payments using the same payment method that the consumer used.
When withdrawing from the contract where a bonus, discount code or promotional code was used, these funds are considered as a discount and are not returned to the user. Only the paid amount is returned to the user.
Material Defect
A material defect exists when:
- the product does not have the properties necessary for its normal use,
- the product does not have the properties necessary for special use for which the customer is buying it, which was known to the seller or should have been known to them,
- the product does not have the properties that were explicitly or tacitly agreed or prescribed,
- the seller delivered a product that does not match the sample or model, except if the sample or model was shown only for information purposes.
The customer must notify the online store www.fresh32.eu of any possible material defect, together with a detailed description of it, within the legally prescribed period and at the same time enable inspection of the article.
Liability for Material Defects
The seller is liable for material defects that the item had when the risk passed to the customer, regardless of whether they knew about it or not. The seller is also liable for those material defects that appear after the risk has passed to the customer, if they are a consequence of a cause that existed before that. Insignificant material defects are not considered.
Delivery
Our contractual partner for delivery of shipments within Slovenia is the GLS delivery service, but Fresh 32 d.o.o. reserves the right to choose another delivery service if the order can be fulfilled more efficiently.
Data Security
The website www.fresh32.eu establishes appropriate technological and organizational measures to protect the transmission and storage of personal data, orders and payments. The provider does not assume any responsibility and cannot be held liable for any damage to computer/hardware equipment or other property and possible virus infections that may occur to the user's equipment due to visiting the website, downloading texts, images, data.
Limitation of Liability
The website www.fresh32.eu strives to the best of its ability to ensure the timeliness and accuracy of data published on the website. However, product characteristics, delivery times or prices may change so quickly that www.fresh32.eu sometimes fails to update the data on the website or an error occurs. In such a case, www.fresh32.eu will notify the customer of the changes and allow them to withdraw from the contract or replace the ordered product.
Similarly, www.fresh32.eu can only withdraw from the contract if an obvious error is detected (Article 46 of the Code of Obligations). An obvious error is considered an error in the essential properties of the product and all mistakes that are considered decisive according to commercial customs or the purpose of the parties, and which www.fresh32.eu would not have confirmed or concluded the contract if it had known about them. This also includes obvious errors in price.
Exclusion of Liability
We reserve the right to disable the website or disable access to it due to technical or other problems and maintenance, which also means disabling or obstructing the use of the online store. In case of technical problems on the website, we reserve the right to cancel submitted orders that were affected by the technical error. In case of order cancellation, we will notify you as soon as possible and inform you of the next steps. The user must ensure appropriate security equipment for accessing the website.
Complaints and Disputes
Fresh 32 d.o.o. respects the applicable consumer protection legislation. Fresh 32 d.o.o. strives to the best of its ability to fulfill its duty of providing an effective complaint handling system.
Complaints are submitted via email address info@fresh32.eu. The complaint handling process is confidential. The website www.fresh32.eu will confirm within 5 business days that it has received the complaint, inform the customer how long it will handle it and keep them informed throughout the process.
We are aware that the essential characteristic of consumer disputes is the disproportion between the economic value of the claim and the necessary time and costs that arise from resolving the dispute, which is also the main obstacle for the consumer not to initiate a dispute before the court. Therefore, www.fresh32.eu strives to the best of its ability to resolve any disputes amicably.
Alternative Dispute Resolution for Consumer Disputes
In accordance with legal regulations, www.fresh32.eu does not recognize other providers of alternative dispute resolution for consumer disputes, as competent for resolving consumer disputes, except for the online dispute resolution platform (ODR) mentioned below, which the consumer can use in accordance with the Alternative Dispute Resolution for Consumer Disputes Act.
Fresh 32 d.o.o., which as a provider of goods and services enables online commerce in the territory of the Republic of Slovenia, publishes an electronic link to the mentioned online dispute resolution platform (ODR) on its website. The platform is available to consumers here.
The mentioned arrangement derives from the Alternative Dispute Resolution for Consumer Disputes Act, Regulation (EU) No. 524/2013 of the European Parliament and Council on online dispute resolution for consumer disputes and amendments to Regulation (EC) No. 2016/2004 and Directive 2009/22/EC.
